Animal Care Terms and Conditions

• I agree to provide food, water, shelter, veterinary care, and the best humane treatment of the foster animal(s) I am given to the best of my ability.

• I am at least 18 years of age or older.

• I agree to administer medication and supplements only as directed, for any foster animal(s) in my care. I agree to trust and follow the treatment plan for the animal(s) in my care as determined by the EBSPCA’s veterinary team.

• I agree to keep the animal(s) at the property listed on the application for sleepovers/fostering, and that I will be their primary caretaker unless multiple parties in the same household attend a foster care orientation.

• I agree to comply with all local and state laws and ordinances relating to the care of domestic animals.

• If I decide to adopt this animal, I will give notice of my intentions and will sign an adoption agreement and pay the adoption fee.

• If for any reason, either party decides that the foster situation is not working, the animal(s) must be returned to the East Bay SPCA.

• I acknowledge that the animal(s) entrusted to me are the property of the EBSPCA. When asked to return the animal(s) I agree to do so without conflict, and I understand that to refuse to do so may result in criminal prosecution against me.

• I agree to immediately return the animal(s) to the EBSPCA if I become incapable of caring for the animal(s). I will not transfer responsibility of my foster animal(s) to another party without express written consent of an EBSPCA staff member.

• If any animal(s) entrusted to me should die while in my care, I will immediately notify the EBSPCA and return the remains to the EBSPCA at once.

• I agree to let the EBSPCA into my home to perform an inspection to ensure that the animal(s) I am caring for are being kept humanely. If the EBSPCA does not feel, for any reason, that this environment is proper for the animal(s), they may repossess the animal(s) at any time.

• Sometimes animals in foster care require medical attention. If the animal(s) in my care need emergency attention, I agree to call the EBSPCA at 510-846-3312 immediately for medical advice. Whether it be to bring the animal(s) into the East Bay SPCA or, if after hours, to one of our partnered Emergency animal hospitals. If I use an outside veterinary service to treat an EBSPCA animal(s), I understand I am financially responsible for all charges from that service.

• I acknowledge that the EBSPCA has recommended that foster animals be kept separate from my own pets and that there is an inherent risk of infecting my pets with known or unknown diseases or illnesses even if they are separated.

• I agree to release, discharge, indemnify and hold the EBSPCA harmless for any and all damage caused by an animal directly or indirectly, to my personal property, self, or pets while performing any and all duties as an East Bay SPCA volunteer.

• I acknowledge my awareness that dogs and cats respond to situations differently, that such responses may be unpredictable, and that the EBSPCA makes no claims, representations, or warranty, either expressed or implied, as to the behavior or temperament of our foster animals.

• I acknowledge that the EBSPCA is not liable for any damages to person, property, or any additional expenses that may occur during the animal(s) stay in my home.

• If any part of this agreement becomes unenforceable, the balance of the terms and conditions remains in place.

Fostering is a fun experience. We hope you enjoy watching an animal that was possibly hurt, abandoned or neglected, thrive under your care. Please feel free to reach out to us with any questions. We are a great resource for tips in helping your foster animal(s) acclimate to your household environment, helping with the introduction of any resident animal(s) or any potential training concerns.
